This is why i don't do model photography, bec if they see your work they will ask and us photographers will get low balled and no profit, that is why if a model asked me to shoot her I am requring $3000 up front and the $3000 is non refundable

no need to butcher anything...
if the agreement was trade (TF) then she can't make money out of your photos. if she did make money, then you are entitled to get a cut from the earnings..
was there a contract signed?
Yeah, what was the agreement? TF*. Otherwise, in Canada, the person who commissions the photos (pays) get the copyright on a basic sense.
Also, if it's TF*, then the model usually gets to use the photos for unpaid self-promotion, etc. (otherwise, why else would she do it).
btw- $3,000 deposit for a shoot? I'm not sure you wont find anyone to agree to that. At most, the costs of a sitting fee deposit might be reasonable.
the agreement was that when i took the photos and if any profit was made when she was promoting them all profits would go to me, i say any model can spread her legs open in a photoshoot lol
well, then you might want to consider just reminding her of the agreement. As to the second part of your reply, i'll refrain from commenting.
